Cinnaminson's Daniel Smith Admits to Sexual Assault of 14-Year-Old Boy

Smith could face seven years in state prison for assaulting the teenager.

 

Daniel Smith, the Cinnaminson man who was charged with sexual assault after meeting with a 14-year-old boy at Wood Park, admitted today in Superior Court he performed the act after finding the victim online, local reports said.

According to Phillyburbs.com, the plea came the same day Smith, 40, was to go on trial. He pleaded guilty to sexual assault and is scheduled to be sentenced Feb. 20.

Smith's negotiated plea calls for a seven-year sentence in state prison, according to the Phillyburbs article. The attempted sexual assault and child endangerment charges would be dismissed. He'll be required to register as a sex offender.

The Lenola Road resident was arrested in January 2011 after Cinnaminson Police said he allegedly sexually assaulted a 14-year-old boy at Wood Park on Dec. 1, 2010. Police said Smith and the juvenile agreed to meet a second time—Jan. 7, 2011—but instead, local police and the Burlington County Prosecutor's Office took him into custody. 

In January 2011, Smith was one of 12 people who pleaded guilty after a federal jury in Philadelphia convicted Richard K. Creamer of conspiracy to manufacture 1,000 or more marijuana plants and maintaining a place for manufacture of controlled substances.

According to the U.S. Drug Enforcement Administration, Smith worked at the city warehouse where, monthly, up to 20 pounds of high-grade marijuana sold for about $5,000 per pound. 

Smith served time for those drug charges. He is currently out on bail from the sexual assault charges.

I just saw him walking the town just before Christmas as if he had done nothing wrong. He has not registered yet because of our system. He has had a very crazy wild life for some time but preying on the kids was one of his "new" things.

Mr. Smith, I realize that you are Dan's father and that you are so saddened by your son's action but you must understand that we are living in a time where you have no excuse for going near a child at anytime. To many children have experienced ugly things by strangers and a grown man who is friends of the family KNOWS to keep away from someone else's child.

Please understand that this town is upset that your son did this to a child. Any man who has children KNOWS what a child looks like when they see them. This boy was on the adult section of Craigslist. I could think this maybe something that a young boy would do just like when we were kids and looked at our dad's "girlie pictures" (they were dressed in swimsuits) that were hidden. Like a child he did not think of what would really happen to him with an adult , a man, your son who spent years body building and wrestling through high school and college. This Child portrayed himself as an adult just like kids do when they try to buy alcohol. Many Mid-teens have not even started their cycle if they are females.So please advise us of the other adult that consented to this ugly act. Is a young girl responsible for a man's sexual force because she was wearing makeup and he could not tell her age? He made me do it sounds like the child had made up his mind to do whatever it took to survive this horrible ordeal. Many woman don't scream when they are raped because they believe that the man will kill them. Dan allowed a young boy or even if we call him a young man into his truck to do a very dirty sexual act. Destroying both the child and his own wife and kids life. How many times have you read about kids claiming to be 21 years of age trying to get alcohol. People who are really concern about illegal activities ask for proof.

mr smith is correct. i think people are carried away. he was never preying on children of the town. i think its all a little harsh
